1. Nature of the Service
The Company operates an online booking service for balloon flight experiences.
The Company acts as a booking agent and intermediary between the customer (“Customer”) and an independent local balloon flight operator, pilot or other service provider (“Service Provider”).
The Company arranges and facilitates the booking and payment process and provides customer support within the scope of its role as booking agent.
The actual balloon flight is performed by the Service Provider. The Service Provider is responsible for the actual operation of the flight, including pilot qualifications, aircraft/balloon operation, safety procedures and compliance with applicable requirements.
Depending on the particular service, the contract for the actual flight may be concluded between the Customer and the relevant Service Provider. The Company remains responsible for the booking and payment facilitation services provided through this website.
Nothing in these Terms limits any mandatory rights or protections granted to consumers by applicable law.
2. Services and Information
Before making a booking, the Customer is provided with information about the relevant service, including, where applicable:

booking procedure;

weather and safety conditions;

age and participation requirements;

3. Booking Procedure
To make a booking, the Customer:

confirms acceptance of these Terms, the Privacy Policy and the Refund, Exchange & Cancellation Policy;

proceeds with payment using an available payment method.

4. Electronic Contract and Acceptance
The contract may be concluded electronically through the website by the Customer taking clear actions intended to complete the booking.
Before payment, the Customer must have an opportunity to review these Terms, the Privacy Policy and the Refund, Exchange & Cancellation Policy.
Acceptance of the contractual terms must be confirmed by a separate affirmative action, such as ticking a checkbox.
By completing the booking, the Customer confirms that they have read and accepted:

The Customer receives a booking confirmation electronically.

5. Prices and Payment
The applicable price is displayed on the website before payment.
Unless expressly stated otherwise, the displayed price includes the services and charges specified on the relevant service page.
Payment is processed through an external payment service provider/acquirer.
The Company does not normally receive or store the Customer’s full bank card details. Payment information is processed by the relevant payment service provider in accordance with its own terms and security requirements.
A booking is confirmed only after successful payment and confirmation of the booking.
If payment is unsuccessful, the booking is not considered completed unless separately confirmed by the Company.
6. Service Location and Meeting Point
The geographic location of the service is indicated on the relevant service page.
The exact launch location of a balloon flight may depend on:

airspace restrictions;

operational conditions.
For this reason, the exact launch and landing locations cannot always be guaranteed in advance.
The Customer will receive the relevant meeting-point information and operational instructions before the flight.
7. Weather and Safety
Balloon flights are weather-dependent.
The final decision as to whether a flight can safely take place is made by the pilot and/or Service Provider.
A flight may be postponed or cancelled because of:

strong or unsuitable wind;
-
rain;
-
poor visibility;
-
thunderstorms;
-
unsafe weather conditions;
-
technical or operational circumstances;
-
other circumstances affecting flight safety.
The Customer agrees to follow the safety instructions of the pilot and Service Provider.
If a flight is cancelled by the Company or Service Provider for weather or safety reasons, the Customer will be offered an alternative date or a refund in accordance with the Refund, Exchange & Cancellation Policy.
8. Customer Responsibilities
The Customer must:

provide accurate booking information;

arrive at the designated meeting point at the agreed time;

follow the instructions of the pilot and Service Provider;
-
comply with applicable safety rules;
-
inform the Company or Service Provider in advance about circumstances that may affect participation.
The Customer must not participate in a flight while under the influence of alcohol, drugs or any other substance that may impair their ability to comply with safety instructions.
The Service Provider may refuse participation where the Customer’s condition or behaviour creates a safety risk.
9. Health and Participation Requirements
The Customer is responsible for determining whether participation in a balloon flight is appropriate for them.
The Customer must inform the Company or Service Provider in advance of any relevant physical limitations, mobility restrictions, pregnancy or other circumstances that may materially affect safe participation.
Specific restrictions may apply depending on the aircraft, pilot, weather conditions and Service Provider.
The Company may provide general information but does not provide medical advice.
10. Children and Minors
Age restrictions may apply to individual balloon flights.
Where a service page specifies an age restriction, the Customer must comply with it.
For minors, participation may require the consent or presence of a parent or legal representative in accordance with applicable law and the requirements of the Service Provider.
The Customer is responsible for checking the applicable age and participation requirements before booking.
11. Arrival, Delay and No-Show
The Customer must arrive at the designated meeting point at the agreed time.
If the Customer is late or fails to appear, the flight may be considered a no-show.
In such circumstances, the Customer may lose the right to the booked flight or refund if the Service Provider is unable to accommodate the Customer.
Any exceptions are considered individually and may depend on the circumstances and the Service Provider’s rules.
12. Cancellation and Rescheduling
Cancellation, withdrawal, rescheduling and refunds are governed by the Company’s Refund, Exchange & Cancellation Policy, which forms an integral part of these Terms.
Nothing in the cancellation policy limits mandatory consumer rights under applicable Armenian law.
13. Refunds
Refunds are processed in accordance with the Refund, Exchange & Cancellation Policy.
Where a refund is approved, it will normally be made using the original payment method, unless another method is required or agreed.
The time required for the refund to appear in the Customer’s account may depend on the payment provider or issuing bank.
14. Independent Service Providers
The Service Provider is an independent business or professional and is not an employee or representative of the Company unless expressly stated otherwise.
The Service Provider is responsible for:

pilot qualifications and operational competence;

flight safety;

compliance with applicable aviation and other requirements;

operational decisions concerning the flight.
The Company is responsible for the booking and payment facilitation services provided through this website and for customer support within the scope of its role as booking agent.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.
15. Changes to a Booking
Where operational circumstances require a change to a booking, the Company or Service Provider will inform the Customer as soon as reasonably possible.
If a material change affects the booked service, the Customer may be offered:

an alternative date;

an alternative arrangement where available; or

a refund where required by applicable law or the Refund, Exchange & Cancellation Policy.
16. Gift Certificates
Where gift certificates are offered, their validity period, conditions of use and any restrictions will be stated at the time of purchase.
Gift certificates are subject to the same mandatory consumer rights as other services.
Unless otherwise required by applicable law, a gift certificate does not automatically constitute a guarantee of a specific flight date, launch location or weather conditions.

19. Intellectual Property

Where such circumstances affect an existing booking, the Company will make reasonable efforts to offer an alternative arrangement or refund where required by applicable law or the Refund, Exchange & Cancellation Policy.
23. Liability
The Company is responsible for the services it directly provides within the scope of its role as booking agent.
The Service Provider is responsible for the actual performance of the balloon flight and matters within the Service Provider’s operational control.
Nothing in these Terms excludes or restricts any liability or consumer right that cannot legally be excluded or restricted under applicable law.
24. Consumer Rights
Nothing in these Terms is intended to restrict or exclude any mandatory rights granted to consumers under the laws of the Republic of Armenia.
Where a provision of these Terms conflicts with a mandatory provision of applicable law, the mandatory legal provision shall prevail.
25. Governing Law
These Terms are governed by the laws of the Republic of Armenia, subject to mandatory consumer protection provisions applicable to the Customer.
Any dispute will first be addressed through good-faith communication and the Company’s customer support procedure.
Nothing in these Terms prevents a consumer from exercising any mandatory rights or remedies available under applicable law.
26. Amendments
The Company may update these Terms from time to time.
The current version will be published on the website with its effective date.
The version applicable to a completed booking is the version accepted by the Customer at the time the booking was made, unless a change is required by law or otherwise legally applicable.
27. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in effect to the extent permitted by law.
The invalid provision shall be interpreted or replaced, where legally possible, in a manner that most closely reflects its original purpose.
